Payments for products, digital content, subscriptions, courses, and certifications are due at the time of purchase unless otherwise stated.

Refunds, if any, are handled on a case-by-case basis in accordance with our published FAQs under “Product Returns, Refunds & Resale,” which are incorporated into these Terms by reference.

Accessing or using digital content may affect refund eligibility. We reserve the right to deny refunds in cases of abuse, excessive refund requests, chargeback abuse, or violations of these Terms.

7. Subscriptions & Automatic Renewal

Some Services are offered on a subscription basis and may automatically renew unless canceled prior to the renewal date. You may manage or cancel subscriptions through your account settings.

Subscription-related communications, including renewal notices and related messages, may be delivered electronically in accordance with our Privacy Policy.

8. AI-Driven Features & Recommendations

By using the Services, you acknowledge that Tune Up Fitness may communicate with you via email or other electronic means regarding products, services, educational content, and marketing offers, in accordance with our Privacy Policy.

Marketing emails include an unsubscribe mechanism. Text message communications are sent only where you have expressly opted in and may be discontinued at any time by following the instructions provided.

12. Prohibited Conduct

You agree not to:

  • Misrepresent professional credentials

  • Copy or redistribute paid content

Our total liability shall not exceed the amount paid by you to Tune Up Fitness in the twelve (12) months preceding the claim.

16. Indemnification

You agree to indemnify and hold harmless Tune Up Fitness Worldwide, Inc. from claims, damages, liabilities, and expenses arising out of your use of the Services, violation of these Terms, or infringement of third-party rights.

17. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

18. Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.

YOU AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Opt-Out:
You may opt out of arbitration by sending written notice to [email protected] within thirty (30) days of first accepting these Terms.

If arbitration is found unenforceable, disputes shall be resolved exclusively in the state or federal courts located in California.

19. Privacy Policy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and share information. By using the Services, you consent to the data practices described in the Privacy Policy.
